What Is Guardianship and Why It Matters

Guardianship is a legal relationship in which a court appoints one person (the "guardian") to make personal, healthcare, and sometimes financial decisions for another person (the "ward") who is deemed unable to make those decisions independently.

A guardian is different from a power of attorney. With a power of attorney, you voluntarily give someone legal authority to act on your behalf. With guardianship, a court determines that you lack capacity and appoints someone to protect your interests whether or not you consent.

Who Needs a Guardian?

Guardianship is appropriate for:

Adults with intellectual disabilities who cannot understand financial matters or make healthcare decisions
Adults with severe mental illness who may lack the capacity to manage their affairs
Adults with advanced dementia or Alzheimer's who no longer understand the nature of their decisions
Adults with severe brain injuries or other conditions that impair decision-making capacity
Minors with disabilities who will not gain capacity to make decisions by age 18
Minors whose parents have died or become incapacitated and who need a legal substitute decision-maker

Guardianship is NOT appropriate for someone who is simply elderly, has poor judgment, or spends money unwisely. Guardianship is a serious intervention that removes a person's legal rights. It should be used only when someone genuinely lacks the capacity to understand their decisions and their consequences.

Types of Guardianship

Not all guardianships are the same. States define several variations, but the most common are:

Full Guardianship

A full guardian has authority over all personal decisions (where the ward lives, medical care, education, social decisions) and all financial decisions (managing assets, entering contracts, accessing funds). A full guardianship is appropriate when the person has profound incapacity and cannot make any meaningful decisions. In New York, this is called a "guardianship of the person and property."

Guardianship of the Person Only

In some cases, a person can manage finances but cannot make healthcare or living situation decisions. A guardianship of the person only allows the guardian to decide medical care, living arrangements, and education, but the ward retains control of finances or a separate conservator manages finances. This is less restrictive and appropriate when there are pockets of capacity.

Guardianship of the Property Only (Conservatorship)

A conservator manages the financial affairs of a person who is unable to handle money but retains the ability to make personal and healthcare decisions. This is common for elderly persons with early-stage dementia who can still communicate but have lost the ability to manage complex finances.

Limited Guardianship

Some states (including New York) now recognize "limited guardianships" where the court specifies exactly which rights are removed and which are retained. Instead of a blanket removal of all rights, a limited guardianship might allow a ward to make healthcare decisions but not financial decisions, or to choose their residence but not make medical decisions. This approach respects the person's autonomy in areas where they retain capacity.

The Guardianship Process

How Do You Get a Guardian Appointed?

In most states, the process begins with a petition filed in probate or family court. A family member, healthcare provider, or even the person's attorney can petition for guardianship. The court then requires:

Clear and convincing evidence that the person lacks capacity to make decisions
Medical evidence (usually a doctor's evaluation or psychiatric assessment)
Due process protections, including notice to the person and a right to be heard
An attorney (in many states) to represent the person's interests

A court cannot simply rubber-stamp a guardianship petition because a family member wants one. There must be genuine incapacity. The person being evaluated has a right to contest the guardianship. If they cannot afford an attorney, the court appoints one.

How Long Does Guardianship Last?

Once established, guardianship can last indefinitely. Unlike a power of attorney, which ends at death, guardianship continues until the court terminates it. This typically happens only when:

The ward regains capacity (rare, but possible)
The ward dies
The guardian requests termination and the court agrees
The ward or another interested party petitions for termination and proves capacity has been restored

Because guardianship lasts so long and is so restrictive, courts are increasingly reluctant to impose it. Many states now encourage alternatives like powers of attorney, limited guardianship, or supported decision-making (where a trusted person helps the individual make decisions but respects their autonomy).

Guardianship Alternatives: When Less Restrictive Options Work Better

Before pursuing guardianship, consider whether a less restrictive alternative might work:

Durable Power of Attorney

If a person has any capacity to understand what they're doing, a durable power of attorney allows them to voluntarily appoint someone to handle financial and healthcare matters. This is far less restrictive than guardianship and respects the person's autonomy. Many people with mild cognitive decline, early-stage dementia, or developmental disabilities can execute a power of attorney with proper explanation and witnessing.

Supported Decision-Making

Supported decision-making recognizes that many people with disabilities can make good decisions if they have support, information, and trusted advisors. Instead of removing decision-making authority, a supported decision-making agreement names people who will help explain options, gather information, and support the individual's chosen course of action—but the individual retains the final say. This is gaining recognition in progressive jurisdictions.

Representative Payee

If a person receives Social Security benefits and cannot manage money, you can petition Social Security to appoint a representative payee. The payee manages only the Social Security funds, not other assets or healthcare decisions. This avoids the full apparatus of guardianship for limited purposes.

Limited Guardianship with Clear Boundaries

Rather than full guardianship, work with the court to establish clear boundaries. A guardian might have authority over healthcare and living arrangements but the ward retains the right to make some financial decisions. Or the opposite. The key is matching the guardianship's scope to the actual areas of incapacity.

Special Needs Planning: Building Financial Security While Preserving Benefits

For parents of children with disabilities—or for adults raising children with disabilities—one of the most important planning tools is the special needs trust, also called a supplemental needs trust.

The Problem: How to Leave Money Without Disqualifying Benefits

A child with a severe disability will likely qualify for Medicaid and Supplemental Security Income (SSI) at some point. These programs are needs-based, which means they have asset and income limits. SSI limits countable assets to $2,000 for an individual. If you leave your child $50,000 in a regular inheritance, that child immediately loses SSI benefits (which include health insurance, nursing care, and other critical services) because assets exceed the limit. The inheritance is quickly depleted paying for care that SSI would have covered. By the time the money runs out, the child's SSI has been cut off and cannot be reactivated as easily.

A special needs trust solves this problem. Money held in a properly drafted special needs trust is not the child's property. It belongs to the trust. The trustee can use trust funds to pay for things SSI doesn't cover—education, therapy, equipment, enrichment activities, transportation, housing assistance—while the child remains eligible for SSI's critical benefits.

How a Special Needs Trust Works

A special needs trust is irrevocable and typically created by a parent or grandparent during their lifetime or through their will. The trust:

Names the beneficiary (the child with the disability)
Appoints a trustee (usually a family member or professional trustee) to manage funds
Specifies permissible distributions for expenses that supplement government benefits
Restricts distributions that would countable as income to SSI (the trustee cannot just hand the beneficiary cash)
Names a successor trustee to manage the trust after the primary trustee dies or becomes unable to serve

The trustee's job is to understand what SSI covers and what it doesn't, then use trust funds strategically to improve the beneficiary's quality of life without triggering benefit loss. This is why trustee selection is so critical.

What Can Special Needs Trusts Pay For?

The trust can pay for:

Housing expenses—rent contribution, mortgage, property taxes, utilities, maintenance (though paying rent directly to the landlord is safer than giving money to the beneficiary)
Medical and dental care not covered by Medicaid—specialized therapy, equipment, prescription costs not covered by insurance
Education and job training—vocational programs, college tuition, job coaching
Transportation—vehicle purchase or modification, specialized transportation services
Recreation and social activities—camps, classes, concerts, travel, entertainment
Technology and equipment—adaptive computers, communication devices, mobility aids
Personal care attendants (beyond what Medicaid provides)
Life and disability insurance (to protect the beneficiary's future)
Personal items and furnishings—clothing, furniture, household goods (within reason)

What It Cannot Pay For

The trust cannot pay for:

Basic food and shelter that SSI already covers (unless structured as a direct payment to the provider, not to the beneficiary)
Cash gifts directly to the beneficiary (this counts as income to SSI and causes benefit suspension)
Anything that would cause the beneficiary to exceed SSI's monthly income limit

These restrictions exist because SSI is designed as a safety net for people with almost no income or assets. Once someone has sufficient outside income or assets, SSI is no longer available. A well-drafted special needs trust works around these rules without violating them.

First-Party vs. Third-Party Special Needs Trusts

There are two types of special needs trusts, and it's critical to understand the difference:

Third-Party Special Needs Trust

This is created by someone other than the beneficiary (typically a parent or grandparent) and funded with the creator's money. A parent creates it in their will and leaves assets to it, or creates it during life and funds it with gifts. The beneficiary has never owned this money. Most special needs trusts are third-party trusts.

First-Party (Self-Settled) Special Needs Trust

This is created by or for the beneficiary themselves, usually when they receive a large sum of money (an inheritance, a personal injury settlement, a lawsuit award). The beneficiary's own assets are placed into the trust, and the trust is managed for the beneficiary's benefit. A first-party trust has special requirements to comply with Medicaid law, including a Medicaid payback provision: when the beneficiary dies, remaining trust funds must repay Medicaid for benefits it paid. Third-party trusts have no such repayment requirement.

Successor Trustees: Planning for Continuity

One of the most important decisions in special needs planning is choosing a trustee and successor trustees. The trustee must:

Understand SSI/Medicaid rules to make distributions without causing benefit loss
Be trustworthy with money and have good judgment
Care about the beneficiary's welfare and well-being
Be willing to handle conflict if other family members disagree with spending decisions
Be young enough to outlive the beneficiary or agree to resign and appoint a successor when ready

Many families choose a sibling as the primary trustee and a professional trustee (a bank or trust company) as a backup. Some create a co-trustee arrangement with one family member and one professional, which provides both personal care and institutional accountability.

You should also consider appointing a "special needs trust advisor" or "trust protector"—an additional person (often a sibling or trusted friend) with the authority to monitor the trustee's decisions and remove the trustee if needed. This protects the beneficiary if the trustee is not doing a good job or if circumstances change.

Guardianship and Special Needs Trusts: How They Work Together

For many families raising a child with disabilities, both guardianship and a special needs trust are necessary.

When the child reaches age 18, guardianship authority typically must be formally established (or renewed) through the court. At the same time, a parent might establish a special needs trust to receive assets when the parent dies or becomes incapacitated. The guardian and trustee might be different people—for example, a sibling serves as guardian (making healthcare and personal care decisions) while a professional trustee manages the financial trust. Or they might be the same person, though splitting these roles sometimes prevents conflicts and provides better oversight.

The key is coordination: make sure the guardianship is established legally (not just assumed), the special needs trust is properly drafted, the beneficiary is named, the successor trustee is willing and able, and the will or estate plan directs assets to the trust rather than to the beneficiary directly (which would cause benefit loss).

Documenting Care Preferences and Medical History

Beyond legal guardianship and financial trusts, many families of people with disabilities benefit from creating a detailed care plan document. This is not legally binding, but it is invaluable to whoever assumes care responsibilities.

A care plan should include:

Medical history—diagnosis, healthcare providers, medications, allergies, past surgeries
Daily routines—sleep schedule, meal preferences, hygiene routines, behavioral triggers and how to manage them
Communication preferences—how the person communicates, what words or gestures mean what, how to comfort them
Therapy and education plans—current programs, providers, progress notes, goals
Financial accounts—bank accounts, Social Security, Medicaid, insurance, benefits
Trusted people—family members, healthcare providers, teachers, group home staff, anyone who plays an important role
Values and preferences—what brings joy, what the person loves to do, what causes distress, long-term goals
Advance planning preferences—where the person should live if something happens to the primary caregiver, preferred facilities or group homes, contingency plans

This documentation becomes invaluable when there's a transition in care. New guardians, trustees, or caregivers can reference it to understand the person's needs and preferences rather than learning through trial and error.

Guardianship Without a Will: The Biggest Mistake

Here's a common and devastating scenario: A parent of an adult with an intellectual disability has not executed a will. The parent dies unexpectedly. The adult child has no legally appointed guardian. The state appoints a public guardian, who may be a stranger managing multiple cases. There's no special needs trust, so any inheritance passes directly to the child, disqualifying them from SSI and Medicaid. Assets are quickly depleted. The child ends up in institutional care, perhaps in a poor facility, instead of the community-based setting the parent would have chosen.

This is preventable. A proper estate plan—including a will or trust that establishes guardianship and creates a special needs trust—protects everyone.

State-Specific Considerations

Guardianship and special needs trust law varies by state. New York, for example:

Recognizes both full and limited guardianship
Requires clear and convincing evidence of incapacity (a higher standard than some states)
Provides due process protections, including the right to counsel
Allows for "supported decision-making" as an alternative
Has specific rules about special needs trust language to comply with state Medicaid law

If you plan to move to another state, or if your loved one might move, consult with an elder law or special needs planning attorney in that state to ensure your plan complies with local law.

Your Action Plan

If you are the parent of a child with a disability, or if you are an adult caring for an aging parent with incapacity:

Assess the need for guardianship. Does your loved one have capacity to make some decisions? Can a power of attorney or supported decision-making work instead? If guardianship is necessary, should it be limited to certain areas?
Establish legal guardianship if appropriate. Don't assume you have authority just because you're the parent or primary caregiver. Guardianship requires court appointment and documentation.
Create a special needs trust if your loved one will inherit money or if you want to leave assets for their care. Work with an attorney who specializes in special needs planning to ensure the trust complies with SSI/Medicaid rules.
Name successor trustees and guardians. Don't assume someone will be willing or available. Ask them. Document the appointment in writing.
Coordinate your estate plan. Make sure your will or trust directs assets to the special needs trust, not directly to your loved one. Make sure guardianship authority is clearly established.
Document the care plan. Write down medical history, daily routines, preferences, and anything someone else would need to know to care for your loved one well.
Review and update regularly. Guardianship law, special needs trust rules, and your loved one's needs all change. Review your plan every few years and after any major change (move, new diagnosis, change in benefits).
